1. Acceptance of Terms and Eligibility

You must be at least 16 years old to use this Site. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Site and to contact us for lesson-related information. These Terms incorporate our Privacy Policy by reference.

Using the Site does not create an ongoing customer relationship by itself. A lesson relationship starts only when we confirm scheduling and relevant details by email or other written confirmation. We may decline to schedule a lesson request for operational, safety, or capacity reasons.

2. Educational Service Disclaimer (Guitar Lessons)

Canal Vertex Guitar Studio provides guitar lessons and educational coaching. The Site and any information provided through it are for general educational purposes and studio administration (for example: scheduling, lesson focus selection, and practical preparation). While we aim to communicate clearly and accurately, we do not guarantee that educational materials, lesson suggestions, or practice planning will produce specific outcomes.

Musical development depends on many variables, including practice consistency, instrument setup, physical comfort, and prior experience. Results vary. Any examples of progress (such as typical tempo gains or practice durations) are illustrative and not a promise of individual performance.

3. Description of the Site and Services

The Site is a lead-generation and information platform for guitar lessons offered in Zwolle, Netherlands, with optional online sessions available across the Netherlands. The Site may include lesson descriptions, pricing information, scheduling guidance, practice concepts, and a contact form to request a lesson slot.

We may update, modify, suspend, or discontinue any part of the Site at any time, including the structure of lesson offerings, lesson focus categories, studio availability, and the content displayed. We are not obligated to maintain any particular content or feature.

4. Acceptable Use

You agree to use the Site lawfully and in a way that does not interfere with other users or our operations. In particular, you agree that you will not:

• Attempt to gain unauthorized access to any portion of the Site, server, or related systems.
• Use scraping, crawling, data harvesting, or automated form submissions without our prior written permission.
• Transmit malware, spyware, or any code intended to disrupt or compromise systems.
• Submit false, misleading, or impersonated contact details, including using someone else’s email or phone number without permission.
• Abuse any contact channel with spam, harassment, or unsolicited commercial messages.
• Bypass security or rate-limiting controls, or attempt to probe or test vulnerabilities.
• Use the Site in violation of applicable sanctions or export-control laws.

We may monitor and investigate suspected misuse and may restrict access where we believe a violation has occurred. We may also preserve and disclose information where required by law or to protect our rights, users, and operations.

5. Intellectual Property

The Site, including its text, lesson descriptions, visual design, logos (if any), layout, and underlying code, is owned by or licensed to CVP Beheer B.V. and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes (for example: reading lesson information and sending a scheduling request).

You may not reproduce, redistribute, publish, publicly display, sell, or create derivative works based on Site content without our prior written consent, except where such use is permitted by mandatory law.

6. Third-Party Services and Links

The Site may reference or integrate third-party services that enable core functionality (for example, mapping embeds on our Contact page) or that may be activated only after cookie consent (such as analytics or advertising measurement tools). Third-party services operate under their own terms and policies.

We are not responsible for third-party websites, services, or content, even if linked from our Site. Your use of third-party services is at your own risk.

7. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties and conditions, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that any information on the Site is complete or suitable for your specific goals, including any educational goals related to learning guitar.

8. Limitation of Liability

To the maximum extent permitted by law, CVP Beheer B.V. and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Site will be limited to the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted under applicable law, including liability for intentional misconduct or gross negligence, or consumer rights that cannot be waived.

9. Indemnification

You agree to indemnify and hold harmless CVP Beheer B.V. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your misuse of the Site, (b) your breach of these Terms, or (c) your violation of any law or the rights of a third party.

10. Force Majeure

We are not liable for any delay or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, fire, flood, war, terrorism, labor disputes, public health emergencies, internet or hosting outages, telecommunications failures, power failures, cyberattacks, and failures of third-party platforms or infrastructure providers.

11. International Use

The Site is operated from the Netherlands. We make no representation that the Site is appropriate or available for use in all locations. If you access the Site from outside the Netherlands, you do so on your own initiative and are responsible for compliance with local laws.

12. Governing Law and Courts (Netherlands)

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Unless mandatory consumer protection rules provide otherwise, the competent courts in the Netherlands will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Site. If you are a consumer resident in the European Union, you may also benefit from mandatory provisions of the consumer protection law of your country of residence.

13. Dispute Resolution (Informal First)

Before starting formal proceedings, you agree to contact us first and allow a 30-day period to attempt to resolve the dispute informally. You can reach us at [email protected]. Please include a clear description of your concern and any relevant dates or communications.

If we cannot resolve the dispute informally, either party may pursue available legal remedies in accordance with Section 12.

14. Termination

We may suspend or terminate access to the Site (including blocking requests) if we reasonably believe that you have violated these Terms or that your use creates a security risk. Termination may occur without prior notice when immediate action is necessary to protect the Site, users, or our rights.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Courts, and any other provisions that by their nature should survive.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and CVP Beheer B.V. regarding your use of the Site and supersede any prior or contemporaneous communications on the subject.

17. Assignment

We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

19. Modifications to These Terms

We may update these Terms from time to time. Changes become effective 14 days after we post the updated Terms on this page, unless a change is required by law to take effect sooner. The “Last Updated” date at the top of this page indicates when the latest revision was posted.

20. Electronic Communications

By using the Site and contacting us electronically, you consent to receive communications from us electronically. You agree that electronic communications, including emails and notices posted on the Site, satisfy legal requirements that such communications be in writing, to the extent permitted by applicable law.
